All sales made by Div9ne Fitness (“Seller”) to you (“Buyer”) are governed by these Terms and Conditions of Sale unless otherwise indicated by Div9ne Fitness in writing.

Div9ne Fitness reserves the right to amend or modify these Terms and Conditions of Sale at any time and without notice at its sole discretion.

All sales are contingent on the Buyer’s acceptance of Div9ne Fitness Terms and Conditions of Sale.

Buyers understand that by making a purchase on this website, they are acknowledging that they agree to the terms set forth. These Terms and Conditions of Sale (as set forth on this website) supersede the terms and conditions of Buyer’s purchase order(s) and will govern all transactions between Buyer and Seller. These Terms and Conditions of Sale also apply to all future transactions unless modified in writing and signed by Seller and Buyer.

Buyer understands that sizing will vary by item. Click on the product description and photos for sizing charts. Contact us if you have questions regarding sizing. Buyer also understands that we are not responsible for items that do not fit.

Shipping Policy

Order and Shipping Confirmation

You will receive an email confirmation once your order has been successfully placed, it will include your order number and shipping method. Please make sure your shipping address is correct as we are unable to redirect goods once they are on route to you. Orders can take up to 3-5 business days to be processed and shipped. Once your order is prepared for shipment you will receive a shipping confirmation email with your tracking information, if applicable. We are not responsible for incorrect shipping addresses entered during checkout. No modifications to sizing or shipping can be made after orders are in queue and processing. Div9ne Fitness cannot be responsible for any shipping delays caused by unpredictable weather, natural disasters, or general delays within the corporate USPS system. Additionally, Div9ne Fitness is not responsible for any lost or stolen shipments or packages.

Shipping Costs

The U.S.

Standard Shipping: 3 to 7 days transit. Please note that order processing may take up to 5 business days after the order is placed for standard shipping.

 

Priority: 1-3 days transit. The cost is calculated at the time of shipping. Please note that order processing may take up to 2 business days after the order is placed for priority shipping.

U.K., Europe, and Canada

Standard International: 14-21 days transit. The cost is calculated at checkout. Please note that order processing may take up to 2 business days after the order is placed for standard shipping.

 

International Trackable: For UK, 4-6 days transit. The cost is calculated at checkout. Please note that order processing may take up to 2 business days after the order is placed for standard shipping.

Taxes

Applicable sales tax will be charged where applicable. Taxes are calculated according to the shipping destination and itemized on the Order Summary page.

Return & Exchange Policy

We do not accept returns unless the item(s) you purchased is defective. If you receive a defective item(s), please contact us at info@div9nefitness.com with details of the product and the defect. Once we have responded back to your email you can send the item(s) you consider defective to:

Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within 48 – 72 hours, whether you are entitled to a store credit or a replacement as a result of the defect. The shipping fee is non-refundable and will not be included in the issued store credit. Therefore, your store credit will be issued for the cost of the item(s) only.

RETURN PROCESS

Return-Form

Mail the item(s) you wish to return back to the address provided on the top of the return form within (7) days of receipt of the item(s). *Item(s) returned after (7) days of receipt or show evidence of wear will not be returned or exchanged.  *You will be responsible for covering all shipping costs to return your item(s). This includes the shipping cost to return the item(s) to the return address as well as the shipping costs for shipment of the new item(s). Once your return is processed, we will issue you a store credit in the form of an Promo Code within 3-5 business days. Your store credit will be in the amount of the purchased price of the returned item(s) only.

*Please note that if we are vending for a conference, all returns will be processed within 3 business days once we return from the conference.

RETURN CONDITION

Please package the item(s) being returned in the original packaging along with the return form. Div9ne Fitness has the right to deny the return of any item(s) that appear worn, washed, or do not have the original tags attached. Item(s) must be free of stains, makeup, fragrance, and deodorant.

Exchanges

We will accept exchanges on regularly priced items within (7) business days. You will be responsible for all shipping fees. Div9ne Fitness is not responsible for unavailability of desired exchange and will issue store credit for item(s) only if an exchange is not possible. Customers wishing to exchange item(s) purchased must first contact info@div9nefitness.com to confirm exchange process within (7) business days of receiving the item(s).

The original packaging must accompany the item(s). Returned items must be safely packaged, shipped, and postmarked within five (7) business days of receiving the item(s). The new item will not be shipped until we receive the original purchase in the original condition.

Late Returns

Any item returned after 7 days from the order date is not eligible for merchandise credit.

​

Receiving a Refund

We do not provide refunds, but we do offer merchandise credit. Be sure to read our size chart carefully before making your purchase. If you receive an item and the sizing is not right for you, we will issue merchandise credit to use towards a future purchase. Merchandise credit is valid for one year. In addition, a merchandise credit will consist of the total value of the item and will not include forfeited shipping fees. Any items that are damaged when we receive them are not eligible for merchandise credit. Merchandise credit does not include any shipping or handling charges, except in the case of faulty or damaged items. Once we receive your returned item and it has been inspected, a merchandise credit will be issued via email. 

 

Promotional Codes, Coupons and Discounts

Promotional discounts cannot be combined at time of redemption unless otherwise stated in the promotional offer, nor can they be applied to previous purchases.  Promotional codes cannot be applied to gift certificates under any circumstances.  Promotional discounts cannot be applied to tax, shipping and handling, or any similar processing charges.  Original discount amount will be deducted from the value of all returned items purchased with a discount at time of purchase (e.g., promotional codes, coupons, etc.).

 

Greek paraphernalia Buyer Terms

“Buyer acknowledges, understands and agrees (hereinafter collectively “agrees”) that he/she is an Authorized Buyer only if buying goods bearing logos, designs, copyrights and trademarks for an National Pan-Hellenic Council member. Buyer agrees that a non-member is not allowed to purchase, own, wear or possess such items.

Buyer also agrees that purchasing NPHC goods for any other reason is prohibited and doing so under false pretense authorizes the NPHC organization to immediately (1) remove the goods from the internet and all social media platforms such as Facebook, Instagram, eBay, amazon.com, etsy.com (hereinafter collectively “Third Party”) and (2) repossess such good(s) from Buyer and Third Party trying to sell them. Buyer agrees to waive its First Sale Doctrine right to subsequently sell any item(s), bearing a NPHC Mark.”

 

Disclaimer of Warranties

Seller cannot guarantee variances in color, shade, size, or construction of merchandise. Seller hereby disclaims all express and implied warranties, including, without limitation, implied warranties of merchantability and fitness for particular purpose.

 

All such warranties are hereby disclaimed and excluded from all transactions between Buyer and seller and shall not apply to the merchandise sold by Seller.

 

Limitation on Liability

Buyer acknowledges that Seller shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages including but not limited to, damages for loss of profits, goodwill, or other intangible losses (even if Seller has been advised of the possibility of such damages), or personal injuries or death resulting from use or sale of the Seller’s merchandise.

 

Force Majeure

Neither Buyer nor Seller shall be liable to the other for delays in performance of its obligation here-under caused by acts of God, war (declared or undeclared), government regulation, terrorism, disaster, strikes, civil disorder, curtailment of transportation facilities, or similar occurrence beyond the party’s control, making it impossible, illegal, or commercially impracticable for one or both parties to perform its obligations under these Terms and Conditions of Sale, in whole or in part.

 

Use of Materials Located on This Site: Copyrights, Trademarks and Restrictions

All materials published on this website (including but not limited to articles, photographs, images, illustrations, audio clips and video clips) are protected by copyrights which are owned and controlled by Div9ne Fitness or the party credited as the provider of the material.  The entire contents of this website are also copyrighted as a collective work under the United States copyright laws, and the selection, coordination, arrangement, and enhancement of such content are protected by copyright.  You shall abide by all copyright notices and other restrictions contained in any material accessed through the website.  No material from this website or any website owned, operated, licensed, or controlled by Div9ne Fitness may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, noncommercial home use, and may print one hard copy of the material on this website for your personal, noncommercial use, provided you keep intact all copyright and other proprietary notices.
